This Legal Notice governs access to, browsing of, and use of the Website, through which we inform Users of their rights and obligations regarding the content displayed on the Website, the logos and trademarks used, as well as the liabilities that may arise from their use.

Access to the website is free of charge.

The purpose of the Website is primarily to present the company’s activities, which consist of the development, production, financing, execution, distribution, and exhibition of feature films, short films, television series, documentaries, miniseries, entertainment programs, and theater productions; the organization of shows; and the exploitation of advertising; as well as the production, financing, execution, distribution, and exhibition of films, short films, television series, documentaries, miniseries, entertainment programs, and theater productions, the organization of shows, and the sale of advertising.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

FONTE FILMS is the owner of, or, where applicable, holds the necessary licenses for, the intellectual and industrial property rights required to operate the Website, as well as all content provided on it, including the Website itself, texts, photographs or illustrations, logos, trademarks, graphics, designs, interfaces, or any other information or content, and the services available through it.

Users have only a non-exclusive right to use the Website, strictly for personal purposes and solely for the purpose of browsing the Website in accordance with this Legal Notice.

4. TERMS OF USE FOR THE WEBSITE

Access to or use of the Website for illegal or unauthorized purposes, whether for profit or not, is not permitted, and the User shall be solely responsible for any resulting consequences. In particular, and without the following list being exhaustive, the following is prohibited:

• Use the Website to transmit or post any material that is defamatory, offensive, racist, vulgar, derogatory, pornographic, or obscene, or that is threatening, or that may annoy, harm, or otherwise affect any person, as determined in FONTE FILMS's sole discretion;

Any breach by the User of the above obligations may result in FONTE FILMS taking appropriate legal action to enforce its rights or fulfill its obligations, and may result in the deletion or suspension of the offending User’s account, without the possibility of any compensation for the resulting damages.

• All information provided by the User through the forms on the Website for the above purposes or any other must be accurate. To this end, the User guarantees the authenticity of all data provided and shall keep the information provided to FONTE FILMS fully up to date so that it always reflects the User’s actual circumstances. 

In any case, the User shall be solely liable for any false or inaccurate statements made and for any damage caused to FONTE FILMS or third parties as a result of the information provided.

5. RESPONSIBILITIES AND GUARANTEES

FONTE FILMS cannot guarantee the reliability, usefulness, or accuracy of all the information contained on the Website, nor the usefulness or accuracy of the content made available to Users through the Website.

Consequently, FONTE FILMS does not guarantee and is not liable for:

• The continuity of the Website's content, services, and/or features; 
• The absence of viruses or other harmful components on the Website or on the server that hosts it;
• The invulnerability of the Website or the impossibility of breaching the security measures implemented for it;
• The lack of usefulness or performance of the Website's content;
• Failures of the Website caused by any type of attack on its servers or those of FONTE FILMS’ third-party service providers, as well as technical or security failures in the systems of any of said providers that prevent the Website from functioning properly;
• Any technical failure of any kind that hinders, delays, or prevents the proper functioning of the Website;
• Damage or harm caused to oneself or to a third party by any person who violates the terms, rules, and instructions established by FONTE FILMS, or through the breach of security systems.

Nevertheless, FONTE FILMS declares that it has taken all necessary measures, within its capabilities and in accordance with current best practices, to ensure the proper functioning of the Website and to minimize system errors, both from a technical standpoint and with regard to the content published on the Website.

FONTE FILMS is not responsible for the accuracy, completeness, or timeliness of the information contained on other platforms to which the Website and/or the Application are linked. FONTE FILMS shall not be liable for any damages that may arise from the use of such information.

FONTE FILMS shall not be liable for causes beyond its control, including but not limited to force majeure, internet access issues, technical problems beyond the reasonable control of FONTE FILMS, acts or omissions of third parties, etc. In all such cases, which are beyond the control and reasonable care of FONTE FILMS, FONTE FILMS shall not be liable to compensate the User for damages, to the extent permitted by applicable law.

6.  FORCE MAJEURE

Without prejudice to the foregoing, FONTE FILMS shall not be liable for any delays or failures that may occur in the access, functioning, or operability of the Website, its content, and/or services, nor for any interruptions, suspensions, or malfunctions of the Website, when these are due to breakdowns caused by any event of force majeure or unforeseeable circumstances.

FONTE FILMS shall not be liable for any failure or delay in the performance of any functionality when such failure or delay is due to events beyond its reasonable control (hereinafter referred to as "Force Majeure Events").

Force majeure shall include any act, event, failure to perform, omission, or accident beyond the reasonable control of FONTE FILMS, including but not limited to the following:

1. Strikes, lockouts, or other industrial action;
2. Civil unrest, riot, invasion, terrorist threat or attack, war (whether declared or not), or threat or preparation for war;
3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster;
4. The inability to use trains, ships, aircraft, motor vehicles, or other means of transportation, whether public or private;
5. Inability to use public or private telecommunications systems;
6. Acts, decrees, legislation, regulations, or restrictions issued by any government or public authority.

It is understood that performance of the obligations will be suspended for the duration of the Force Majeure Event, and FONTE FILMS will be granted an extension of time to fulfill such obligations for a period equal to the duration of the Force Majeure Event. FONTE FILMS shall use all reasonable means to bring the Force Majeure Event to an end or to find a solution that allows it to fulfill its obligations despite the Force Majeure Event.

FONTE FILMS will respond to complaints or inquiries as soon as possible and, in any case, within a maximum period of one (1) month.

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on data protection (the “GDPR”), all personal data provided during the use of the Website will be processed in accordance with the provisions of the Privacy Policy, which Users must read and, where applicable, accept and/or consent to.

9. SAFEGUARD CLAUSE

All the provisions of this Legal Notice must be interpreted independently, and the remaining provisions will remain in effect even if one of them is declared null and void by a court ruling or final arbitration decision. The affected provision or provisions shall be replaced by another provision or provisions that achieve the objectives of this Legal Notice.

10. APPLICABLE LAW AND JURISDICTION

Access to and use of the Website shall be governed by and construed in accordance with Spanish law.

In the event of any conflict or discrepancy arising from the interpretation and/or application of this Legal Notice, the competent courts shall be those specified in the applicable legal regulations; and, where permitted, any dispute shall be submitted to the courts and tribunals of the city of Madrid.
